Zan Hub advised on financing of PPP project

President of the European Bank for Reconstruction and Development (“EBRD”) Suma Chakrabarti signed a number of agreements in Astana on 5 June concerning energy saving projects and in the field of public-private partnership (“PPP”). In particular, the EBRD provides a loan of up to KZT 2.6 bn. for the implementation of the Pavlodar street lighting project.

Zan Hub, led by Madiyar Bekturganov and Aituar Madin, advised EBRD on the financing modernisation and trust management of the street lighting system in the city of Pavlodar in the Republic of Kazakhstan, to be implemented via public-private partnership.  The Project will bring energy efficiency, operational efficiencies and improved quality of street lighting with introduction of new energy-efficient technologies. The Project is supported by Pavlodar city and oblast municipalities through PPP arrangements with consortium of Taiwan company – Everlight and two Kazakhstani companies.

Zan Hub reviewed Loan Agreement, Concession Agreement, Consortium Agreement, O&M, equipment supply and other project agreements for delivering a balanced contractual framework and sustainability of the Project. We made due diligence of tendering stage, PPP award, acceptance of PPP obligation by state and state, quasi-state, corporate approvals and permits for the Project and executing project agreements.
