Innovations in the State Procurement Law

On 15 of November 2021, amendments introduced to the State Procurement Law, mainly coming into effect on 1 January 2022.
The changes introduce new methods of tender, contracts (offtake, service model), increase limit for procurement by request of a quote (up to 8,000 MCI), expand the use of e-wallet, new procurement methods (electronic store and electronic catalog).
The amendments envisage creation of a database of passports about potential tenderers/suppliers and an electronic depository that stores information about their experience.
The conciliation commission with the participation of Atameken will decide on exclusion of a supplier from the register of mala fide participants included due to evasion of entering a contract.
An offtake contract is defined as an agreement concluded between a customer and a potential supplier for the guaranteed procurement of goods planned for production in the future. Offtake contracts with an investment component will be awarded in a two-stage tender.
The procedure for awarding performance-based contracts (service model contracts) will be further detailed by the Public Procurement Rules.
