Drafting of Guarantee and Indemnity Deed under LMA standards for Development Bank of Kazakhstan

Zan Hub (as Kazakh law counsel) together with Latham & Watkins (as English law counsel) advised to Development Bank of Kazakhstan on approval of standard form of the Guarantee and Indemnity Deed in accordance with requirements and standards of Loan Market Association.
This deed is governed by English law. All disputes shall be settled by arbitration in accordance with Arbitration and Mediation Rules of the International Arbitration Centre, and legal place of arbitration shall be Astana International Financial Centre.
The approach followed by Development Bank of Kazakhstan shows its in-depth knowledge in understanding of the advantages of English law in protections of DBK’s interests, granting of additional comfort to foreign investors on application of commonly used instruments in implementation of infrastructure and other break-through projects in Kazakhstan, as well as popularisation of International Arbitration Centre under AIFC, as reasonable alternative to other international arbitration courts.
